Witnesses to the incident said the two men both made threats, with Waterman producing a gun and pointing it at Sinatra.
Sinatra walked out of the casino and returned to his Palm Springs home without fulfilling the rest of his three-week engagement there. Waterman was booked on a charge of assault with a deadly weapon, but was released without bail. Refusing to make "two pictures for the price of one", he left the production and did not return. Fox agreed to drop the claim on condition that he appear in another picture of theirs. Sponsored by American Tobacco Company's Lucky Strike brand of cigarettes, the show featured the top ten songs of each week. He often started shouting about this on the set of the television show when he phoned his home and could not reach Gardner.
